
STYLING TERMS & CONDITIONS
These Styling Services Terms & Conditions (the "Terms") are entered into between you ("you", "your", and "Client") and Nikija Denise ("Stylist", "we", "us" and "our"). In consideration of the mutual covenants, and upon the conditions, set forth herein, Client requests and Stylist agrees to provide styling services as follows:
SERVICES: In order to understand and clarify the services and relationship, Client and Stylist acknowledge and agree that:
- Styling is a relationship which is designed and defined by the Client with the Stylist's agreement, and which is based on the Client's expressed interests, goals and objectives.
- Stylists does not provide counseling, therapy, advice, answers or direction to the client without a deposit.
- Stylist uses discussion, questions and requests to assist Client as Client identifies personal and/or business goals, develops strategies and action plans intended to achieve such goals, and monitors progress towards implementation of the action plans all in relation to styling.
- Client is responsible for his/her own achievements and success and Stylist cannot and does not promise that client will take any specific action or attain specific goals. STYLIST MAKES NO WARRANTY OF ANY KIND THAT THE SERVICES, OR ANY PRODUCTS OR RESULTS OF THE USE THEREOF, WILL MEET ALL OF CLIENT'S OR ANY OTHER PERSON'S PURPOSES OR NEEDS, OR ACHIEVE ANY INTENDED RESULT.
- Stylist reserves the right to refuse service to anyone, for any reason.
HOURS OF OPERATION: Telephone Consultations and communications are Tue-F 6:00 PM - 9:00 PM, Saturdays 10:00 AM- 6:00PM. We do not offer consultations on Sundays or Mondays. Any phone and text communication outside of those hours will be determined and initiated by the Stylist. Client understands that Stylist may not respond to any text or message received until the aforementioned hours. Consultation/ fitting hours are not applicable to photoshoot/ event in-person service hours.
SHOPPING HOURS: Shopping hours are determined by Nikija Only, not the client. We will be sure to have your items on time, however we will shop according to our own set schedule.
FEES: Client agrees to pay and has paid, Stylist a fee of agreed rate for their work and has signed up for the said Wardrobe Consulting package.
- Client agrees to pay styling fees with the following payment options: Zelle via information provided.
- Assessment Fees and Package services are due upon receipt of the invoice.
- Client understands shopping/ services will not begin until stylist retainer deposit is paid in full.
- Client understands final retainer balance must be paid at the beginning of the fitting appointment or event if there is no fitting. Clothing will not be released until balance is paid.
- All Stylist Fees are non-refundable, however you may use your credit for a future date.
CLOTHING BUDGET: The Client is responsible for their own clothing budget. This amount is determined during The Stylist and Clients consultation. Shopping does not begin until the clothing budget is received by the Stylist. Any funds not used will be refunded to the client via the same payment method. The Clothing Budget and Stylist Retainer are two separate fees. The Stylist does not use her own funds (retainer) to purchase the Clients' clothing under any circumstances. If clothing goes over budget, the Client will be required to pay the overage at the time he/she receives the invoice. Failure to do so will result in the return of items, regardless of event/ photoshoot date.
Stylist and Client will agree on a standard time for sessions. Once this time is established, it will only be reserved upon the receipt of the deposit. If Client needs to cancel an appointment at least 24-hour notice shall be provided or Client may be charged for the appointment.
OVERTIME HOURS: A $50.00 fee will be added for each hour after agreed package timeframe for photoshoots or events; and is due at the completion of said event.
TRAVEL FEE: Stylist applies a $50 travel fee to all in-home services for clients residing more than 20 miles from her home office in Antioch, CA. Additional fees starting at $100 may apply to clients living 30 miles from home office. We offer a virtual closet service to clients who would like to work around these fees. Keep in mind, virtual services are not applicable to photoshoots. Services out of state or that require travel by plane will require a round trip ticket as well as lodging with confirmation provided by the Client unless arrangements have been discussed and agreed upon by the Stylist.
REFUNDS and EXCHANGES: Client acknowledges and agrees that there will be no refunds or exchanges for items removed from photoshoot/ event by the client. - NO EXCEPTIONS. Once an event/photoshoot is complete, the Client has the choice of keeping the items or returning them. If the latter, the Stylist will return the items and issue a refund within 14 business days. Note: The Stylist will not issue a refund until she has received it from the vendor, regardless of unforeseen delays. In addition, the Client understands there are some retailers that only issue store credit. In those instances, if possible, the Stylist may offer to give the Client the receipt to exchange on their own time. The Stylist will not provide that service.
CONFIDENTIALITY: Stylist and Client acknowledge that they may obtain confidential personal and/or business information from each other and agree to keep and maintain such information confidential and not to disclose or use such information without the other's prior verbal or written consent. However, this information may be released if (1) Stylist or Client gives specific permission to release information; (2) the information has become public knowledge; and/or (3) Stylist or Client is required to release the information by law. Client is aware that confidentiality may not apply in situations where records are subpoenaed. Client is aware that some means of communication such as wireless telephones and e-mail may not be secure from eavesdropping.
USE PHOTOS/ BTS FOOTAGE: Stylist and/or her assistant will take pictures and videos known as BTS or "Behind the Scenes" footage during photoshoots and events. Those videos/ pictures will be posted on the Stylists social media platforms unless otherwise objected by the Client. The Stylist will however be mindful of the privacy of special events such as weddings, birthdays or other reveals with a specific date set by the client; and will not post until specified timeframe.
WAIVER: Client acknowledges and agrees that in the course of the services, Stylist may ask Client questions which may be personal, challenging or disturbing. Client waives and releases any claims arising or resulting from Stylist's questions, actions or services except for Stylist's breach of her obligations.
HOMEWORK: You may receive homework or instruction from the Stylist prior to your Styling session. Please complete all homework in a timely manner so your stylist can prepare for your session or prepare to shop. In some instances, failure to complete homework or provide the Stylist with necessary information will result in a rescheduling or cancellation regardless event or photoshoot date.
GUESTS AT SESSIONS: We encourage all clients to attend styling and fitting sessions alone, without friends or family. In the event these sessions take place in the home of the Stylist, NO guests are allowed to accompany the Client inside the home, no exceptions. Even supportive, loved ones who mean well can take away from your session, which is your opportunity to receive kind, collaborative one-on-one feedback with your stylist.
HOME VISITS: Nikija is a professional stylist who enters the private homes of her clients for business purposes only. We always assume the best of our clients, but if she or her assistant feels uncomfortable in any way, we have the right to leave immediately and discontinue all future service, without refund.
FORCE MAJEURE: Stylist will not be liable for delays in delivery or for failure to perform it's obligations due to causes beyond it's reasonable control, including , but not limited to, material shortages, labor disputes, transportation delays, unforeseen circumstances, acts of God, acts or omissions of other parties, acts or omissions of civil or military authorities, government priorities, fire, strikes, floods, severe weather conditions, computer interruptions, terrorism, epidemics and pandemics, quarantine or other governmental restrictions, riots, or war. Stylist's time for delivery or performance will be extended by the period of such delay.
Client understands that both Stylist and Client has the right to terminate this contract at any time for any reason without refund of styling retainer.
